The cycle Recicla't Espaitec made a new session, «How to decide the way to protect the results of R&D&I projects», taught by José Manuel Marhuenda, area director of Levante and Andalusia of Clarke Modet, a leading group in services in the field of Industrial and Intellectual Property in Spanish and Portuguese speaking countries.
In the training session it was highlighted that the Industrial and Intellectual Property It plays a fundamental role in any company that bases its business on technology or on a business model with an innovative component. Highlighting that in the case of a startup, this becomes more important, since it can mean a competitive advantage that encourages investment and company valuation. Also listed were the different Industrial Property rights such as trademarks, patents, industrial designs and others that do not require registration in registries to enforce them against third parties such as trade secret or copyright. Another of the aspects that were named were the requirements for Pantetability:
- New: Not being included in the state of the art. State of the art: Everything available to the public by oral, written, use, marketing or any other means.
- Inventive step: An invention has an inventive activity when it cannot be obtained from what is already known (state of the art) in a way that is obvious to an expert in the field.
- Industrial application: When it can be manufactured or used in any type of industry, including agriculture.
- Descriptive Sufficiency: The report must be clear and concise so that the invention can be put into practice by someone skilled in the art.
Regarding patents, it was also highlighted that the majority of applicants who start with a Spanish patent secure protection in Spain. Within a period of one year from the filing of the patent in Spain (priority year) presents the international patent of the Patent Cooperation Treaty (PCT), since it wants to be protected in countries outside the European Union.
One of the points that were detailed was the negotiation with investors so as not to lose control of the intellectual investment along with the most appropriate brand protection strategy when starting the internationalization of the company.
The cycle Recicla't Espaitec is an initiative of Espaitec with the objective of facilitating the expansion and improvement of business skills of companies linked to Espaitec, the business fabric of Castellón, UJI research groups interested in generating future spin-offs and the business fabric of the province of Castellón, which has the support of the Department of Innovation, Universities, Science and Digital Society of the Generalitat Valenciana.
